Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the WhosOnBoard rental booking platform and the equipment rental services provided by San Pedro Ocean Sports / West Harbor Rentals ("we", "us", "our"). By completing a booking you agree to these Terms.

1. Reservations & payment

  • Bookings are confirmed only upon successful payment authorisation.
  • Prices are displayed in USD and include any applicable fees listed at checkout.
  • We reserve the right to adjust pricing without notice; the price at time of booking is locked for that booking.

2. Cancellation & refunds

  • Free cancellation: Cancel 24 hours or more before your scheduled start time for a full refund.
  • Late cancellation: Cancellations made less than 24 hours before the start time are non-refundable.
  • No-show: Failure to arrive within 15 minutes of your scheduled start time without prior notice is treated as a no-show; no refund is issued.
  • Weather: If we cancel your reservation due to unsafe weather or conditions you will receive a full refund or a credit toward a future booking.

3. Rental start time & late arrival

Your reserved rental period begins at the scheduled start time, not when you arrive or begin riding. Please arrive 15–20 minutes early for check-in and a safety briefing. Late arrivals do not extend the end time. Equipment may be released to other guests if you are more than 15 minutes late without prior notice.

4. Late returns

Equipment must be returned by the end of your rental period. A grace period of 15 minutes applies. Returns after the grace period will incur a late-return fee of $20.00 per hour (or part thereof), charged in addition to your original rental fee. You will be notified by email (and SMS if opted in).

5. Damage & loss

You are responsible for any damage to or loss of equipment during your rental period, beyond normal wear and tear. Repair or replacement costs will be assessed at current market rates. A deposit may be collected at check-in and applied toward any damage charges.

6. Age requirements

The primary renter must be 18 years of age or older and must present a valid government-issued photo ID at check-in. Certain equipment types have additional minimum age requirements that will be displayed at the time of booking.

7. Safety & conduct

  • You must complete the safety briefing before departing.
  • Rental equipment must be operated only by persons listed on the booking unless otherwise agreed in writing.
  • Equipment must not be used outside the designated area or in a manner inconsistent with safe operation.
  • You must comply with all applicable local, state, and federal laws while operating rental equipment.

7.1 Navigation Rules & Horn Signals

You must understand and follow basic navigation rules while on the water:

Horn/Sound Signals:

  • 1 short blast — I am altering my course to starboard (turning right)
  • 2 short blasts — I am altering my course to port (turning left)
  • 3 short blasts — I am operating in reverse / backing up
  • 5 or more short blasts — Danger signal / unclear intentions / warning
  • 1 prolonged blast (4-6 seconds) — Leaving dock / approaching blind bend / general warning

Right-of-Way & Traffic:

  • When meeting another vessel head-on, pass port-to-port (left side to left side).
  • Stay to the right (starboard) side of channels and fairways.
  • Large vessels (container ships, cruise ships, ferries) have limited maneuverability — stay clear of navigation channels and give them wide berth. Do not cross in front of large vessels.
  • Yield to all vessels larger than yours and to all commercial traffic.
  • Maintain a safe speed and keep a proper lookout at all times.

8. Liability waiver

A separate liability waiver is required for each participant before equipment is issued. The waiver link is included in your booking confirmation email. Signing the waiver is a condition of receiving equipment.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to a booking is limited to the amount you paid for that booking. We are not liable for indirect, incidental, or consequential damages.

10. Privacy & SMS

Use of your personal data is governed by our Privacy Policy. SMS messaging terms are at SMS Terms.

11. Location Tracking & GPS Monitoring

Your GPS location is monitored while your rental is active. By completing a booking and accepting the liability waiver you consent to the tracking described here.

What we collect:

  • Real-time GPS coordinates (latitude, longitude, accuracy radius) transmitted from your phone's browser via the Geolocation API while you are on the water.
  • Collection begins when equipment is checked out and stops when the rental period ends. No location data is collected outside the active rental window.

Why we collect it — permitted uses only:

  • On-water safety monitoring — dock staff see your live position and can dispatch assistance if you are stationary, drifting, or approaching a hazard.
  • Emergency SOS — pressing the SOS button on the rental app attaches your GPS coordinates to the alert so first responders can reach you quickly.
  • PTT (push-to-talk) communications — your location is included in voice transmissions so staff identify your vessel instantly.
  • Geofencing — an automatic alert is triggered if equipment leaves the permitted operating area.
  • Accountability and dispute resolution — GPS records may be used to verify return time, assess late fees, or reconstruct events after an incident.

Browser location permission:

Your browser will prompt you to allow location access when you open the rental link. You must grant this permission to enable safety monitoring. If you previously denied it, follow the steps in our Rental Agreement § 9b (Location Tracking) or ask dock staff for help at check-in.

What we do not do:

  • We do not track you before equipment check-out or after rental end.
  • We do not sell, share, or use location data for advertising.
  • We do not share your location with third parties except emergency responders when an SOS is activated, or as required by law.
  • Location data is retained as part of the rental record for safety and liability purposes only. See our Privacy Policy § 2 (Location Data).

12. Governing law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Los Angeles County, California.

13. Changes to these Terms

We may update these Terms at any time. The version in effect at the time of your booking governs that booking. Continued use of our platform after changes constitutes acceptance of the revised Terms.
