Rental Agreement & Terms of Service

1. Parties
“Company” means San Pedro Ocean Sports, Inc.,
located at Berth 77, San Pedro, CA 90731,
reachable at (310) 694-6923 and sanpedrooceansports.com.
“Renter” means the individual who completed the booking
and all persons using the rented equipment under that booking.
2. Equipment & Rental Period
- Equipment is rented for the specific time slot selected at booking. The rental period begins when equipment is physically checked out (scanned/released by staff) and ends at the scheduled return time.
- Equipment must be returned to the same rental counter where it was received, by the scheduled return time.
- Equipment is provided in the condition documented at check-out. Renter accepts responsibility for returning it in the same or better condition.
- Rental occupancy — single vs. tandem craft:
A rental is for the capacity of the specific craft rented, for the
duration booked — not for an unlimited number of people taking turns.
- Single-person craft (single kayak, single SUP, single hydrobike, etc.): one rider at a time. The rental does not permit rotation among multiple people.
- Tandem / two-person craft (tandem kayak, tandem hydrobike, etc.): up to two riders simultaneously. It is not a pass for additional people to rotate in and use the craft during the same rental window.
- If your group needs more people on the water, book additional equipment at the time of reservation or ask staff about availability before launching.
3. Payment, Fees & Taxes
- Rental rates are as shown at time of booking and are inclusive of applicable taxes.
- A 6% booking/processing fee applies to all reservations.
- Card payments are subject to a 3.5% credit-card surcharge.
- All fees are non-refundable except as described in Section 4 (Cancellation).
4. Cancellation & Refund Policy
- More than 24 hours before rental start: Full refund, minus the booking/processing fee.
- Within 24 hours: 50% of the rental amount refunded; booking fee retained.
- No-show or cancellation after rental start: No refund.
- Refunds are credited to the original payment method within 5–10 business days.
5. Security Deposit
- Certain equipment types (including Jet Ski / PWC) require a security deposit charged or pre-authorized at check-in.
- The deposit is fully refunded when equipment is returned on time, in acceptable condition, with all required conditions met (including fueling where applicable).
- The Company may forfeit (capture) all or part of the deposit to cover:
- Late fees (see Section 6)
- Damage to equipment (see Section 7)
- Failure to fulfill the fuel requirement (see Section 8)
- Any other charges arising under this Agreement
- Forfeiture of the deposit does not limit the Company’s right to pursue additional amounts where damage exceeds the deposit amount.
6. Late Returns
A 15-minute grace period applies after the scheduled return time at no charge. After the grace period expires, late fees accrue in the increments shown below, billed as a ceiling (any portion of an interval = full interval charged):

- Late fees are automatically recorded against the booking and may be collected from the security deposit or charged to the payment method on file.
- Jet Ski / PWC exception: A 20-minute fuel-stop window (Section 8) is added to the scheduled return time before the grace period begins. Late fees do not accrue during the fuel window.
- Repeated or excessive late returns may result in denial of future rentals.
6a. Extending Your Rental
If you would like more time on the water, you may request an extension before your rental ends, subject to equipment availability.
- How to request: Use the Extend Rental button on the real-time rental screen (accessible via the link in your booking confirmation), or contact dock staff directly via the PTT (push-to-talk) button on the rental app.
- Subject to availability: Extensions are not guaranteed. If the equipment is reserved by another party immediately after your slot, an extension cannot be granted.
- Pricing: Extensions are billed at the standard rental rate for the additional time selected, charged to the payment method on file at the time of the extension request.
- Jet Ski / PWC: The fuel-stop window (Section 8) resets to the new return time when an extension is approved.
- An approved extension is not a waiver of late fees if equipment is returned after the extended return time.
7. Equipment Damage & Loss
- Renter is responsible for all damage to or loss of the rented equipment that occurs during the rental period, except for normal wear and tear.
- Damage is assessed by comparison of check-out and return condition, documented by staff at each event.
- Renter agrees to pay for all repair or replacement costs, which may exceed the deposit amount.
- Renter must not attempt to repair any equipment themselves.
- Theft or loss of equipment will be reported to law enforcement and Renter will be held liable for full replacement value.
8. Jet Ski / PWC Fuel Policy
- All Jet Ski / PWC rentals must be returned with a full tank of fuel. The fuel tank is confirmed full at check-out; Renter agrees to return it full.
- Before returning the Jet Ski to the rental dock, Renter must stop at Jankovich Fuel Dock and fill the tank. Fuel is charged to the Company’s line of credit — Renter pays nothing for fuel.
- A 20-minute fuel-stop window is built into every Jet Ski rental at no additional charge. This window begins at the scheduled return time. No late fees accrue during this window.
- If equipment is returned without being fueled, a no-fuel penalty of $40.00 will be charged from the security deposit, regardless of whether a late fee also applies.
- The fueling requirement and no-fuel penalty are displayed to Renter: (a) on the equipment booking card before booking is confirmed, (b) on the real-time rental status page during the rental, and (c) at the return counter when staff processes the return.
- By completing this booking the Renter acknowledges the fuel requirement and consents to the no-fuel penalty being charged from the deposit if not met.
9. Minimum Age Requirements & Minor Participants
9a. Primary Renter / Equipment Operator
- The primary Renter — the person booking and signing this Agreement — must be at least 18 years of age. Minors may not serve as the primary Renter under any circumstances.
- Renter must hold any license or certification required by California law for the equipment being operated. Harbors & Navigation Code §658.5 requires a California Boater Card for PWC operators born on or after January 1, 1966.
9b. Non-Motorized Equipment (kayak, paddleboard, SUP, hydrobike, etc.)
- Participants operating non-motorized equipment solo must be at least 11 years of age.
- Younger children may participate as a passenger in a tandem / two-person craft operated by an adult (18+), provided the child is able to wear a properly fitted, USCG-approved Personal Flotation Device for the duration of the rental. Staff will assess PFD fit at the dock before launch; if a properly fitting PFD cannot be secured, the child may not participate.
9c. PWC / Jet Ski — Passengers
- PWC may only be operated by the primary Renter who is at least 18 years of age.
- Passengers riding behind an adult operator must be able to wear a properly fitted, USCG-approved Personal Flotation Device and must be physically capable of holding on to the PWC or operator for the duration of the rental. Staff will assess PFD fit and rider readiness at the dock before launch; if a properly fitting PFD cannot be secured or the passenger cannot safely hold on, they may not ride.
9d. Minor Participants — Waiver & Assumption of Liability
- A parent or legal guardian must execute both this Rental Agreement and the separate liability waiver on behalf of any participant under 18 years of age, prior to equipment release.
- By signing on behalf of a minor, the parent/guardian expressly assumes all liability arising from the minor’s participation and releases the Company from any claim related to the minor’s use of rented equipment.
- The adult Renter of record is responsible for the minor’s compliance with all safety rules at all times on the water.
9e. PFD Requirements
- California law (Harbors & Navigation Code §652.5) requires all children under age 13 to wear a USCG-approved PFD at all times on any moving vessel. The Company will provide appropriately sized PFDs at no additional charge.
- Renter is responsible for ensuring any child’s PFD fits properly before leaving the dock. Staff will assist with fitting on request.
- Equipment must be used only in designated areas and in compliance with all applicable federal, state, and local laws and the Company’s posted rules.
- All participants must wear provided PFDs at all times on the water.
- Channel & No-Anchor Zone (CNA) / Restricted Area Compliance — Immediate Termination: Renters must remain clear of the center of any navigational channel and out of all posted Controlled or No-Anchor Areas (CNAs), restricted zones, and any area marked as off-limits by the Company, the harbor, or applicable law. If any participant is found in the center of a channel, inside a CNA, or in any other restricted area, the rental will be terminated immediately, the equipment will be retrieved, and no refund will be issued for any unused portion of the rental period. Repeated or willful violations may result in denial of future rentals and forfeiture of the deposit.
- No rider switches: Only the individuals listed on the booking at check-in may use the rented equipment. Swapping riders — allowing a person who did not check in to take over or share the equipment mid-rental — is strictly prohibited. The rented equipment must be returned to the dock before any change of riders can be arranged. Unauthorized rider switches void the rental agreement and may result in immediate equipment retrieval, forfeiture of the deposit, and denial of future rentals. A rental is for the capacity of the craft booked, not for as many people as possible taking turns: a single-person craft is for one person; a tandem craft is for two people, simultaneously — for the duration of the booked rental window.
- Renter must not operate equipment under the influence of alcohol, drugs, or any substance that impairs judgment or reaction time.
- Renter must immediately report any accident, injury, or equipment malfunction to Company staff via the rental app (PTT/SOS) or by returning to the dock.
- Unauthorized sub-rental or commercial use of rented equipment is strictly prohibited.
9b. Location Tracking & GPS Monitoring During Rental
What we collect
- GPS coordinates (latitude, longitude, accuracy radius) reported by your phone's browser while you are on the water.
- Location is sampled continuously via the device browser's Geolocation API and transmitted to our dock operations system in real time over an encrypted connection.
- No location data is collected before equipment check-out or after the rental period ends.
Why we collect it
- Safety monitoring: dock staff can see your position on a live map and respond immediately if you are in distress, stationary for an unusual length of time, or approaching a hazard.
- Emergency response (SOS): when you press the SOS button on the rental app your last known GPS coordinates are attached to the alert so responders can locate you immediately.
- PTT / push-to-talk: your location is included with voice communications so staff know which vessel is calling without needing to ask.
- Geofence alerts: if equipment travels outside the permitted rental area an automatic alert is sent to dock staff.
- Operational accountability: GPS records may be used to verify return time, assess late fees, and reconstruct events in the event of an accident or dispute.
Browser permission requirement
Your phone will ask for permission to share your location when you first open the rental app link. You must tap “Allow” (or “Allow While Using”) to enable tracking. If you previously denied location access for this site, you will need to reset it in your browser settings before your rental begins:
- iPhone / Safari: Settings → Privacy & Security → Location Services → Safari → set to “Ask Next Time or When I Share” or “While Using”. Then reopen the rental link and allow the prompt.
- Android / Chrome: Tap the lock icon in the browser address bar → Permissions → Location → set to “Ask every time” or “Allow”. Then reload the page.
- Our dock staff can walk you through this at check-in if needed.
What we do not do
- We do not track you before or after your rental window.
- We do not sell, share, or use your location data for advertising.
- We do not share your location with third parties except emergency response services when an SOS is activated, or as required by law.
- Location data is retained as part of the rental record for liability and safety audit purposes only (see our Privacy Policy).
Renter's consent to this location tracking policy is recorded electronically as part of the liability waiver signed before equipment is released. Declining to allow location access does not void this Agreement but may prevent dock staff from rendering timely emergency assistance; Renter assumes full responsibility in that event.
10. Limitation of Liability & Assumption of Risk
Water sports and watercraft operation involve inherent risks including, but not limited to, capsizing, collision, drowning, and personal injury. RENTER EXPRESSLY ASSUMES ALL SUCH RISKS.
TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, THE COMPANY, ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER LOSS SUSTAINED BY RENTER OR ANY THIRD PARTY ARISING FROM THE USE OF RENTED EQUIPMENT, EXCEPT WHERE CAUSED BY THE COMPANY’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
Note: A separate liability waiver must be signed by all renters and riders at or before check-in. This Rental Agreement governs the commercial terms of the rental; the waiver governs personal liability and assumption of risk.
11. Governing Law & Dispute Resolution
- This Agreement is governed by the laws of the State of California, without regard to conflict-of-law principles.
- Disputes shall be resolved in the courts of Los Angeles County, California.
- Any claim must be brought within one (1) year of the rental date.
12. Changes to These Terms
The Company may update these Terms at any time. The version and effective date shown at the top of this page apply to your booking. Material changes will be highlighted in the booking flow.
