Privacy Policy

San Pedro Ocean Sports / West Harbor Rentals ("we", "us", or "our") operates the WhosOnBoard rental booking platform. This Privacy Policy explains what information we collect, how we use it, and your rights regarding that information.

1. Information we collect

  • Identity & contact: first name, last name, email address, mobile phone number, date of birth.
  • Address: street address, city, state/province, postal code, country — collected to support booking verification.
  • Payment: we do not store full card numbers. Payments are processed by Stripe, Inc. and subject to Stripe's Privacy Policy.
  • Booking data: equipment reserved, rental start/end times, booking status, waivers signed.
  • Usage data: pages visited, browser type, IP address, device identifiers — collected automatically via server logs and cookies.
  • SMS opt-in status: whether you consented to receive text messages (see SMS Terms).
  • Location data: real-time GPS coordinates (latitude, longitude, accuracy radius) transmitted from your phone's browser while your rental is active. See Section 2 below.

2. Location data we collect during your rental

Your GPS location is monitored while equipment is checked out to you.
  • Source: your phone's browser Geolocation API, sampled continuously and transmitted in real time to our dock operations platform over an encrypted connection.
  • Window: collection begins at equipment check-out and ends when the rental period closes. We do not collect location data before or after that window.
  • Purpose (safety only):
    • Live on-water safety monitoring by dock staff.
    • Emergency SOS — GPS coordinates attached to your alert so first responders can locate you.
    • PTT (push-to-talk) — location included so staff identify your vessel instantly.
    • Geofence alerts if equipment leaves the permitted operating area.
    • Accountability records used to verify return time, assess late fees, or reconstruct events after an incident.
  • Retention: location records are retained as part of the rental record for safety and liability audit purposes. Booking records are kept for a minimum of 7 years (see Section 6 below).
  • Not sold or used for advertising: we do not sell, share, or process your location data for any commercial purpose beyond what is listed above.
  • Consent: you consent to this collection by completing a booking and signing the pre-rental liability waiver. You must also grant browser location permission when prompted. See Terms & Conditions § 11 for full details including how to enable the permission on your device.

3. How we use your information

  • Process and manage your rental bookings.
  • Send booking confirmations, receipts, and operational notifications (email and, if opted in, SMS).
  • Verify age requirements for certain equipment rentals.
  • Comply with legal obligations (waivers, liability records).
  • Improve our services and troubleshoot technical issues.
  • Prevent fraud and enforce our Terms & Conditions.

4. SMS messaging

If you opt in at checkout, we may send you transactional SMS messages (booking confirmation, late-return fees, standby-queue updates). We do not use your mobile number for marketing without separate consent. Reply STOP at any time to unsubscribe. See our full SMS Terms.

5. Sharing your information

We do not sell or rent your personal data. We may share it with:

  • Stripe — payment processing.
  • Azure Communication Services — email and SMS delivery.
  • WhoGivesAShift — staff scheduling integration (booking times only, no payment data).
  • Emergency responders — GPS coordinates are shared when you activate the SOS function on the rental app, or as required by law to protect safety.
  • Law enforcement — when required by law or to protect safety.

6. Data retention

Booking records are retained for a minimum of 7 years to satisfy liability and tax obligations. You may request deletion of your personal contact information after this period by contacting us.

7. Your rights

Depending on your jurisdiction you may have the right to access, correct, or delete your personal data, or to object to certain processing. To exercise these rights, contact us at info@sanpedrooceanssports.com.

8. Cookies

We use session cookies to maintain your cart and login state. No third-party advertising cookies are used. You may disable cookies in your browser but some site features may not work.

9. Children's privacy

Our platform is not directed at children under 13. We do not knowingly collect personal data from children under 13. Minor participants in a booking must be added by an adult renter.

10. Changes to this policy

We may update this policy periodically. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our services after changes constitutes acceptance of the revised policy.
